Pfizer Inc. is now appealing a lower court judge's decision that extended its stay of the patent application for the drug until December 31, 2017.
The drugmaker is seeking a refund of about $5.2 billion for U. damages, or roughly $13.6 billion if a settlement is reached with Pfizer.
Judge Kenneth B.itzerland has ordered Pfizer to pay $3.1 million to the plaintiff, a $6.6 million to the defendant, and $1.1 million to the plaintiff for legal fees and legal costs.
Plaintiffs have filed a lawsuit against the government seeking injunctive relief and damages for a variety of alleged injuries.
"Pfizer is not violating any federal law by withholding its patent and by obstructing justice," Judgeitzerland wrote in a judgment.
In a statement, the company said: "The decision upholding the validity of the patent on which the plaintiff's lawsuit is based is in accordance with the law as applied by the U. Court of Appeals for the Federal Circuit."

A new treatment for that can work within 10 minutes has launched in the UK.
It is a gel called Eroxon, and has been clinically proven to work for people with mild to severe erectile dysfunction.
Eroxon is made by Futura Medical, a pharmaceutical company based in the UK.
